Youth plaintiff KALIKO (no last name provided) performs a traditional dance during a community festival celebrating the settlement of the landmark climate change lawsuit Navahine v. Hawaii Department of Transportation in Honolulu. The state and the plaintiffs reached a settlement in the constitutional climate lawsuit brought by 13 youth against the State of Hawaii and the Hawaii Department of Transportation (HDOT). The youth plaintiffs, represented by Our Children's Trust and Earthjustice, have secured the first settlement agreement in a constitutional climate case paving the way for systemic decarbonization of a state transportation system. The settlement agreement recognizes that youth have constitutional rights to a clean and healthful environment, mandates the creation of a Greenhouse Gas Reduction Plan based on the best scientific evidence today, and reforms HDOT budgeting and programing to prioritize the decarbonization of transportation, creating new key roles within the agency to supervise all aspects of emissions reductions throughout the transportation sector. The State of Hawaiii has agreed to take all actions necessary to achieve zero emissions no later than 2045. The settlement agreement will be supervised by the court which retains jurisdiction and can step in and ensure the agreement is enforced until zero emissions targets are achieve through 2045.Informations importantes
